Agreement to Terms
By downloading, installing, or using Gratitude Genie (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Indie Genie Labs ("we", "us", or "our").
Description of Service
Gratitude Genie is an AI-powered gratitude journal and mood tracking app available on iOS and Android. The App features Gratina, an AI companion that helps you journal through conversation, track your mood, generate monthly memory cards, receive weekly emotional intelligence reports, and more.
Account & Eligibility
You must be at least 13 years old to use the App. By creating an account, you represent that you meet this age requirement. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Free & Premium Tiers
Gratitude Genie offers both a free tier and an optional premium subscription:
- Free tier includes 20 daily messages with Gratina, full mood tracking, the Gratitude Bucket, the self-help library, daily reminders, streaks, and encrypted storage
- Premium tier unlocks unlimited daily messages, weekly emotional intelligence reports, advanced monthly memory cards, all gratitude depth levels, and full resilience score tracking
We reserve the right to modify features in either tier. We will not remove core free features without reasonable notice.
Subscriptions & Billing
Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription through your device's app store settings
- Refunds are handled by Apple or Google in accordance with their respective refund policies
- We do not collect or store payment card information directly
AI-Generated Content
Gratitude Genie uses artificial intelligence (powered by OpenAI) to generate Gratina's responses, monthly memory cards, weekly insight reports, and other personalized content. You acknowledge and agree that:
- AI-generated content is for personal reflection and journaling purposes only — it is not professional medical, psychological, therapeutic, or legal advice
- While we strive for quality, AI responses may occasionally be inaccurate, incomplete, or unexpected
- You should not rely on AI-generated content as a substitute for professional help when needed
- We continuously work to improve content quality but cannot guarantee perfection
Your Content
You retain full ownership of all content you create within the App, including journal entries, mood data, and saved gratitude items. Your journal entries are encrypted before storage and are only accessible to your authenticated account.
By using the App, you grant us a limited license to process your data solely for the purpose of providing and improving the service (e.g., generating AI responses, creating memory cards, calculating insights).
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or to violate any applicable laws
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Attempt to circumvent security features, rate limits, or subscription restrictions
- Use automated tools or scripts to access the App or its services
- Reproduce, redistribute, or create derivative works based on the App
- Interfere with or disrupt the integrity or performance of the App
Intellectual Property
The App, including its design, code, AI models, branding, the Gratina character, and all related intellectual property, belongs to Indie Genie Labs. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
Third-Party Services
The App uses third-party services that have their own terms and conditions:
- OpenAI — AI conversation and content generation
- Convex — backend infrastructure
- RevenueCat — subscription management
- Google Play Services — Android app services
- Expo — push notifications and updates
Internet & Device Requirements
Certain features of the App require an active internet connection. We are not responsible for the App not functioning fully if you do not have internet access. You are responsible for any data charges incurred by your mobile provider while using the App, including roaming charges when used outside your home region.
You are responsible for keeping your device charged and your operating system up to date. We may release updates to the App and recommend that you install them to ensure the best experience.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, Indie Genie Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, emotional distress, or reliance on AI-generated content.
Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and delete your account at any time. Upon termination:
- Your license to use the App ends immediately
- You may request deletion of your data by contacting us
- Sections that by their nature should survive termination (such as intellectual property, limitation of liability, and dispute resolution) will continue to apply
Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you through the App or via email.
Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
